Andrew Condon handed 50-year prison term for killing gas station attendant

Iroquois County Judge Gordon Lustfeldt (Monday) sentenced a rural Ashkum man to 50 years in prison for the 2012 shooting death of a Gilman gas station attendant. The judge also said denied a new trial for 36-year-old Andrew Condon.


Condon was convicted in August of killing 27-year-old Jonathan Rubin. That happened after Rubin refused to sell Condon cigarettes because he didn't have a proper ID.


Condon continues to say he's innocent. He maintains the evidence didn't support the verdict. Condon did apologize to the Rubin family members, stating justice wasn't served for either side.


Impact statements were presented to the court prior to the sentencing.


Key evidence in the trial, presented by the state, included an incriminating box of ammunition found in Condon's home –that box minus the exact number of rounds fired at the victim inside the Gilman gas station. The firearm used to kill Rubin was never found, but the state reasoned with the argument that Condon had enough time to dispose of evidence before he was questioned by police.
