In Iroquois Circuit Court (Tuesday) Judge James Kinzer sentenced a former Watseka man to 9 years in prison for aggravated battery with a firearm involving a shooting in the summer of 2015. Jerry Pintelon was found guilty in April for the August shooting that wounded Kylie Schwartz in a Watseka neighborhood. A jury convicted Pintelon of aggravated battery and aggravated discharge of a firearm.

The April trial was the second time Pintelon had to answer to the charges. A jury acquitted him of attempted murder while finding him guilty of aggravated battery and aggravated discharge of a firearm.

A defense motion for a new trial was granted and while Pintelon was not re-tried for the attempted murder charge he was already acquitted of…the State prosecuted him again for the aggravated battery and aggravated discharge offenses.
The second trial was at Pintelon’s request.

Tuesday’s sentence disposition ordered Pintelon to serve nine years for aggravated battery with a firearm charge and six years for the aggravated discharge of a firearm within 1,000 feet of a school charge. The sentences will be served concurrently.
