SAFE-T Act poses another hurdle for law enforcement
Illinois' SAFE-T Act finds another arrested suspect freed from cusody. 58-year-old Terry Gardner of Milford struggled with arresting Iroquois County Sheriff deputies, and even allegedly tried to disarm one of the officers during a traffic stop in rural Sheldon. Once in custody at the county jail, Police reported Gardner again struggled with correctional staff, refusing to be booked in and photographed and fingerprinted.
Gardner was arrested when deputies stopped a vehicle for a traffic violation. A powdery substance believed to be cocaine was found during a search of the vehicle. During the altercation with deputies, Gardner allegedly attempted to gain control of a deputies taser. He's now charged with possession of a controlled substance and drug materials,2-counts of aggravated battery to a police officer, and attempting to disarm a peace officer.
Sherifff's Police reported provisions of the SAFE-T Act required Gardner be released pending a court date to answer to the charges on file.
A woman driving the stopped vehicle, 49-year-old Suzett Fassoth of Milford, was released on charges of possession of a controlled substance and drug paraphernalia.
